Section I.4: Intrastate DS-3 Local Access

 

I.          SERVICE DESCRIPTION: Intrastate DS-3 Local Access is provided by MCI Legacy Company. Intrastate DS-3 Local Access is a high capacity digital local access arrangement that consists of a Local Access circuit (Local Loop) that relies on DS‑3 transmission technology provided by the Local Exchange Carrier or other access provider that is used to connect Customer's Premises to the MCI Legacy Company’s Point-of-Presence (POP) to provide Customer access to MCI Legacy Company services.

 

II.         DEFINITIONS: The Online Definitions apply.

 

III.        FEATURES AND OPTIONS (intentionally blank)

 

IV.        RATES AND CHARGES: For new circuits installed on or after March 1, 2010, when the local loop is provisioned entirely on MCI Legacy Company-owned fiber (Type 1 – Lit Building), or on other Company facilities designated as Type 1 on the Guide, Type 1 monthly recurring charges apply. Network configuration is determined at the time of the Customer’s initial order. Company may substitute other facilities of Company’s choosing, including replacing non-MCI Legacy Company facilities with MCI Legacy Company facilities and/or with facilities from another non-MCI Legacy Company facilities provider, as applicable, without changing the classification of the network configuration associated with the Customer’s Service as initially ordered provided that Customer service levels will remain at least the same.

2.         Intrastate DS-3 Local Access Non-Recurring Charges. A non-recurring per-circuit charge of $1000 will apply.

 

3.         M1/3 Multiplex.

 

3.1       Verizon Business Services III. A $950 monthly recurring charge applies, per Central Office Connection, to demultiplex/multiplex up to 28 T‑1 (1.544 Mbps) channels from/into a TDS‑45 (44.736 Mbps) digital signal.

 

4.         Network Connection Charge.

 

4.1       Verizon Business Services III, Verizon Business Services II and Pre-Verizon Business Services.  The following monthly recurring and non-recurring charges will apply, per connection, only for circuits installed on or after October 1, 1998, if access is Customer‑provided, except that for certain circuits in legacy networks designated by Company, the prior charges will remain in effect for circuits installed from October 1, 1998 through April 30, 2014, if access is Customer-provided.

4.2       Verizon Business Services I.  The following monthly recurring and non-recurring charges will apply, per connection, only for circuits installed on or after October 1, 1998, if access is Customer‑provided.

5.         Cross Connect Charge. A monthly $250 charge will apply, and a non-recurring charge of $500 will apply, per connection, for circuits installed on or after October 1, 1998, for the electrical connection of a MCI Legacy Company affiliate DS-3 Local Access circuit to an interexchange carrier other than the MCI Legacy Company.

 

6.         Charges for special arrangements, including engineering, construction, labor, facility costs and other costs associated with making the interconnection compatible between the Customer's and the MCI Legacy Company’s equipment and/or facilities are additional and at the expense of the Customer and shall be charged on an individual case basis.

 

7.         There will be no allowance for service deferral on the Local Loop. All charges for access begin on the original service request date, or the Telco delivery date, which ever is later.

 

8.         Paper Invoice Charge applies.

 

9.         Convenience Payment Charge applies.

 

10.       Other Non-Recurring Charges.

 

10.1     Customer Support Services charges apply.

 

10.2     Intrastate Administrative Non-Recurring Charges apply.

 

V.         TERMS AND CONDITIONS: The Online Master Terms - Terms and Conditions of Service apply, except as follows.

 

1.         Credit Allowance for Interruption of Local Access Service.

 

2.         Commitment Period. Customer commits to pay the applicable circuit MRC for any Network Services Local Access Service circuit of DS3 or larger for a minimum of 12 months, which Customer must pay even if the circuit is cancelled sooner (unless cancelled by Customer for Cause, as defined in Customer’s service agreement).
