Frame Relay Services
III.2.2 Frame Relay "Test Drive" Guarantee
Beginning November 16, 2001, eligible Customers will receive the following benefits.
Eligibility: To be eligible, a Customer:
must enter into a contract with the Company prior December 1, 2003 to for new Frame Relay Service, excluding Economy Frame Relay Service, in the U.S. Mainland and commit to a term of service of at least one year (New Service);
must not have subscribed to Frame Relay Service during the 1-year period prior to entering the contract for New Service;
submit to the Company complete orders for New Service within 90 days of entering the contract; and,
request in the orders installation of all New Service within 120 days of the contract date.
Benefits: Upon satisfaction of the following conditions, an eligible Customer who becomes dissatisfied with Company performance in connection with the provision of New Service (i) may terminate such service without liability for the underutilization and early termination charges for New Service as set forth in the contract and (ii) will receive a credit equal to the customer's installation charges imposed by the Company for Replacement Service. The following conditions apply:
the Customer must notify the Company in writing within 120 days of the contract date that it wishes to discontinue service (Notice);
the Customer's Notice must set forth the reason(s) for service discontinuance; and,
the Customer must subscribe to new Company-provided service (Replacement Service).
