U.S. Estado Privacy Law Addendum

 

 

This U.S. State Privacy Law Addendum (“Addendum”) is hereby incorporated into and made part of the applicable Agreement between Customer and Verizon (which means Verizon Wireless, if applicable, under the Agreement). 

 

 

1.     1. DEFINITIONS

 

1.1      “State Privacy Law” means any U.S. state privacy law or regulation that is applicable to services provided by Verizon under the Agreement.

 

1.2      “Covered Information” means any personal information regulated by a State Privacy Law that Verizon collects, receives, or processes from or on behalf of Customer in providing services under the Agreement. 

 

2.     2. USE OF COVERED INFORMATION 

 

2.1      2.1          Verizon will collect, retain, use, disclose or otherwise process Covered Information solely to fulfill its obligations in the provision of services, except for the uses set forth in the Agreement or as otherwise permitted by applicable State Privacy Law.  Permitted uses of Covered Information include without limitation Verizon internally using Covered Information to improve and manage the quality of the services, to debug and repair the services, y to provide security for Covered Information.  

 

2.2      2.2          Verizon will not sell Covered Information. For the purpose of this Addendum, “sell” has the meaning set forth in applicable State Privacy Law.

 

2.3      2.3          Verizon will not share Covered Information, except as permitted by law or as necessary to provide services under the Agreement.  For the purpose of this Addendum, “share” has the meaning set forth in applicable State Privacy Law.

 

2.4      2.4          Verizon will not combine Covered Information with personal information acquired by Verizon outside of the business relationship with Customer.

 

2.5      2.5          Without limiting the foregoing, Customer may direct Verizon to process Covered Information in accordance with Customer’s written instructions.  

 

3.     3.  PROTECTION OF COVERED INFORMATION

 

3.1      3.1          Verizon will implement reasonable security procedures and practices, appropriate to the nature of the Covered Information, to protect such Covered Information from unauthorized or illegal access, destruction, use, modification, or disclosure, and as otherwise required by applicable State Privacy Law.

 

3.2      3.2          Verizon may use subcontractors/vendors to provide services and to fulfill its obligations to Customer under any State Privacy Law.  Verizon will bind such subcontractors/vendors to written terms that require them to assist Verizon in complying with applicable State Privacy Law.

                                                                                                  

4.     4.  ADDITIONAL OBLIGATIONS

 

4.1      4.1          Verizon will, upon reasonable notice, cooperate with Customer to take commercially reasonable steps to remediate any unauthorized use of Covered Information.

 

4.2      4.2          To the extent required by State Privacy Law, Verizon will promptly assist Customer in responding to verified consumer requests for access to, deletion of, or correction to Covered Information.  Customer will promptly inform Verizon of any such request and provide the information necessary for Verizon to respond to the request.  Verizon has implemented a data privacy dashboard to assist customers with submitting requests.  Customer agrees to utilize this dashboard for submitting consumer privacy requests involving Verizon.

 

4.3      4.3          Verizon will notify Customer in the time frame required by the applicable State Privacy Law if Verizon determines that it can no longer meet its obligations under such State Privacy Law. 

 

4.1              4.4          Customer remains responsible for taking reasonable and appropriate steps to assess risk related to the processing of Covered Information.  Customer retains the right to take reasonable steps to ensure that Verizon processes Covered Information in a manner consistent with applicable State Privacy Law.
