Guide Type 11 (Local and Long Distance with IP – Trunk Solution)

 

1.         Eligibility:  To be eligible for this plan, the Customer must subscribe to:

 

·                     this plan prior to March 1, 2004;

 

·                     Local and Long Distance Service Plus Plan; and,

 

·                     Internet Dedicated Services for a term of service which equals or exceeds one year as follows at: Tiered 384 kbps if the Customer subscribes to Offering A under this Guide Type 11; or, Tiered 768 kbps if the Customer subscribes to Offering B under this Guide Type 11.

 

The Company may cancel a Customer’s service and Customer accounts, without incurring any liability, immediately, and without notice, if the Customer fails to satisfy the following conditions. The Customer may not:

 

·                     subscribe to service under this plan for more than 24 trunks per Customer location;

 

·                     use auto-dialers or any similar type of device in connection with service under this plan; and,

 

·                     use service under this plan in a call center environment or in connection with any similar such application.

 

2.         Definitions:  For the purposes of this plan, the following definitions apply:

 

Eligible Intrastate Service:  On Net Long Distance Voice Services Option 1 Outbound Service (excluding Llamadas Card) usage that originates and terminates in one state as set forth in the Companion Intrastate Tariffs or other appropriate governing documents.

 

Eligible Interstate Usage:  On Net Voice Services Option 1 Outbound Service (excluding Llamadas Card) usage that originates in the U.S. Mainland and Hawaii and terminates in the U.S. Mainland, Alaska, Hawaii, Puerto Rico, the U.S Virgin Islands, Guam, and CNMI.

 

Existing Customer:  A Customer who, at the time of subscription to the plan, is receiving service under this Guide and the tariff or other appropriate governing document containing the Companion Intrastate Service.

 

Local Line:  A single, voice-grade communications channel, including an Automatic Number Identification (ANI.)

 

New Customer:  A Customer who, at the time of subscription to the plan, is not receiving service under this Guide and the tariff or other appropriate governing document containing the Companion Intrastate Service.

 

3.         Service Availability:  

 

1.         Service Offerings:  Under Offering A, Customer subscribes to 18 local trunks and Tiered 384 kbps Internet Dedicated Services under this Guide Type 11.  Under Offering B, Customer subscribes to 12 local trunks and Tiered 768 kbps Internet Dedicated Services under this Guide Type 11.

 

2.         Companion Intrastate Service and Companion Local Service:  Companion Intrastate Service and Companion Local Service is available in the following states, as follows:

 

Arizona:  Companion Intrastate Service and Companion Local Service are described in the MCI Communications Services, Inc. Arizona Tariff No. 1 and MCImetro Access Transmission Services, LLC AZ Tariff No. 1, respectively, on file with the Arizona Corporation Commission.

 

Arkansas: Companion Intrastate Service and Companion Local Service are described in the MCI Communications Services Inc. APSC Tariff No. 2 and MCImetro  Access Transmission Services  PSC  Tariff No. 4, respectively, on file with the Arkansas Public Service Commission.

4.         Monthly Recurring Charges:

 

A monthly recurring charge will apply for each Offering under this plan. The monthly recurring charge is:  in lieu of the rates and charges set forth in Local and Long Distance Service Plus Plan; and, identical to, and shall not be in addition to, any monthly recurring charge applicable to Companion Intrastate Service and Companion Local Service.  The following monthly recurring charges apply, based on the Customer’s term of service under this Guide Type 11:

For purposes of this SCA Guide Type, the monthly recurring charge for Local and Long Distance Service Plus Plan is comprised of: (i) a charge for voice service equal to (a) for 18 trunks, $1170 for a 1-year term of service and $1112 for a 2-year term of service and (b) for 12 trunks $780 for a 1-year term of service and $741 for a 2-year term of service; and, (ii) a charge for Internet Service equal to (a) for service at 384 kbps, $499 for a 1-year term of service and $474 for a 2-year term of service and (b) for service at 768 kbps,  $599 for a 1-year term of service and $569 for a 2-year term of service.

 

5.         Other Charges:

 

1.         An $300 per T-1 installation charge applies for standard installation of service under this Guide Type.  This charge is comprised up a $200 charge for voice service and a $100 charge for Internet Service. 

 

6.           Benefits:  Customers will receive the following benefits on in lieu of the benefits set forth in Local and Long Distance Service Plus Plan for service provided under this plan.

 

1.         Offering A:  Upon installation of interstate service and Companion Local Service, a Customer who subscribes to Offering A will receive:

 

·                     with respect to each of 18 local trunks per T-1 bundle ordered, an allotment of 1,250 minutes per monthly period that may be used for (i) Eligible Interstate Usage and (ii) Eligible Intrastate Service as described in the Companion Intrastate Service tariff.  A Customer whose usage exceeds this allotment in any monthly period will be charged $0.05 per minute for Eligible Interstate Usage that exceeds this allotment (Overage Usage Charge).  When a call under this offering begins prior to the completion of Customer's monthly allotment and ends after completion of the allotment, the Customer will be charged $0.05 per minute for Eligible Interstate Usage for the portion of the call after completion of the allotment.  For Customers enrolling in this plan after the first day of a billing cycle, whose allotment begins after the first day of a billing cycle or whose enrollment in this plan ends before the last day of the billing cycle, the allotment will be pro-rated for that billing cycle.  The portion of a Customer’s allotment that is not exhausted at the end of a monthly billing period will not carry over to the next month. 

 

·                     unlimited exchange service usage as described in the Companion Local Service tariff or other appropriate governing document; and,     

 

·                     Tiered 384 kbps of Internet Dedicated Services

 

2.         Offering B:  Upon installation of interstate service and Companion Local Service, a Customer who subscribes to Offering B will receive:

 

·                     with respect to each of 12 local trunks per T-1 bundle ordered, an allotment of 1,250 minutes per monthly period per local trunk that may be used for (i) Eligible Interstate Usage and (ii) Eligible Intrastate Service as described in the Companion Intrastate Service tariff in that monthly period.   A Customer whose usage exceeds this allotment in any monthly period will be charged $0.05 per minute for Eligible Interstate Usage that exceeds this allotment (Overage Usage Charge).  When a call under this offering begins prior to the completion of Customer's monthly allotment and ends after completion of the allotment, the Customer will be charged $0.05 per minute for Eligible Interstate Usage for the portion of the call after completion of the allotment.  For Customers enrolling in this plan after the first day of a billing cycle, whose allotment begins after the first day of a billing cycle or whose enrollment in this plan ends before the last day of the billing cycle, the allotment will be pro-rated for that billing cycle.  The portion of a Customer’s allotment that is not exhausted at the end of a monthly billing period will not carry over to the next month. 

 

·                     unlimited exchange service usage as described in the Companion Local Service tariff or other appropriate governing document; and, 

 

·                     Tiered 768 kbps of Internet Dedicated Services.

 

7.         Termination of Service.

 

1.         The following provisions will apply to Customers who terminate service, continue to maintain a Company account, and do not subscribe to other service offerings under this Guide:

 

1.         For existing Customers who disconnect Companion Local Service only, plan service and Companion Intrastate Service will terminate and the Customer will be automatically re-subscribed to the service offerings to which the Customer subscribed at the time of subscription to this plan under this Guide Type, the Companion Intrastate Service tariff and Tiered Internet Dedicated Service at the bandwidth the Customer subscribed to service under this Guide Type.

 

For existing Customers who disconnect Companion Local Service and Companion Intrastate Service, plan service and Companion Intrastate Service will terminate and the Customer will then be automatically re-subscribed to the service offering under this Guide to which the Customer subscribed at the time of subscription to this Guide Type and Tiered Internet Dedicated Service at the bandwidth the Customer subscribed to service under this Guide Type.

 

For new Customers who disconnect Companion Local Service only, plan service and Companion Intrastate Service will terminate and the Customer will be automatically subscribed to On Net Voice Services Option 1 under this Guide, On-Net Service-Voice under the Companion Intrastate Service tariff and Tiered Internet Dedicated Service at the bandwidth the Customer subscribed to service under this Guide Type.

 

For new Customers who disconnect Companion Local Service and Companion Intrastate Service, plan service and Companion Intrastate Service will terminate and the Customer will be automatically subscribed to On Net Voice Services Option 1 under this Guide, On-Net Service-Voice under the Companion Intrastate Service tariff for intraLATA intrastate service only and Tiered Internet Dedicated Service at the bandwidth the Customer subscribed to service under this Guide Type.

 

For Customers who disconnect Internet Service, plan service will terminate and Customer will be automatically subscribed to Local and Long Distance Service Plus Plan under this Guide and applicable state tariffs.

 

2.         The following monthly recurring charges will apply to Internet Dedicated Service to which a Customer subscribes under Section 5.1.1. of this Guide Type, based on bandwidth and term of service:

8.         Other Conditions:

 

8.1       Billing:  Customers subscribing to service under this plan via a Company-designated Internet site will receive Electronic Billing invoicing only, to the extent that Company is able to provide them with Electronic Billing.

 

8.2       Customers subscribing to this plan may not receive the benefits of any other discounts, including term plan discounts, or promotional offerings, except those provided under:  (i) the On-Net Voice Services Optional Calling Plan to which the Customer subscribes under Section 1 of this plan; (ii) Checkbook Promotion 2003; and (iii) SCA Guide Types 2 through 10, excluding the Local-to-Local Promotion.
