Verizon RCS Terms of Service

Effective May 1, 2024 until replaced

These Terms of Service ("Terms") for Verizon RCS ("RCS Service") is between you as our Subscriber and User of our RCS Service and Verizon Wireless ("Verizon", or "we" or "us") and sets forth the terms and conditions under which you agree to use and we agree to provide the RCS Service. By using this RCS Service, you agree to our Terms of RCS Service. If you are under 13 years old, you must not use this RCS Service. You must be 16 years of age to use this RCS Service. In addition to the minimum required age to use the RCS Service, if you are a minor in your jurisdiction (i.e., not old enough to have authority to agree to these Terms) your parent or guardian must agree to our Terms on your behalf. If you do not agree with these Terms, you must stop using the RCS Service. You can discontinue your use of the RCS Service by turning off this setting in the messages app through which you access the RCS Service. Verizon may make updates to these Terms at any time by posting them so you should check regularly for updates. By continuing to use the RCS Service, you are accepting such revised Terms. If another person or entity is the owner of the wireless account you use for this RCS Service, or the primary account holder of the device you are using with this RCS Service, or a third party you have authorized to allow the viewing of your Messages including content, you authorize Verizon to share your account information and any Messages with such person, entity or third party. You are responsible for use of the RCS Service and for use by any third parties with whom you share your account, device, or use of the RCS Service. Any use of the RCS Service by third parties you authorize are subject to these Terms and their use may impact your RCS Service and/or right to use the same.

    The RCS Service.

    The RCS Service allows you to use the Rich Communication Services protocol ("RCS") to send and receive messages ("RCS Messages"). RCS Messages are exchanged via telephone numbers, so RCS Messages may go through other service providers (like carriers or other messaging apps) to reach those telephone numbers. You agree that your device may occasionally be checked for RCS capabilities to ensure you can send and receive RCS Messages. Verizon may occasionally exchange your device information (including device identifiers or SIM card information) with its service providers to provide RCS Messages. RCS Messages are transmitted over the Internet, and therefore you may incur data charges in connection with your use of RCS Messages. Further, if the number with which you wish to exchange RCS Messages is not RCS capable, your messages may be transmitted instead as standard text messages (SMS/MMS), which will count toward your device's messaging plan. To use the RCS Service, you must have an eligible device and messaging client, a valid U.S. mobile number, and you must agree to these Terms. The Service will not work with messaging or data blocks on your account.

    Changes to and Availability of the RCS Service.

    Verizon may change, upgrade, improve discontinue, suspend or modify the RCS Service or any part, supported devices or platforms or any features at any time without notice to you. You agree that Verizon has no obligation to provide any feature or part of the RCS Service and that we may suspend or discontinue the RCS Service at any time in whole or in part at our discretion. Our RCS Service may be interrupted, including for maintenance, repairs, upgrades, new releases, network or equipment failures or if we terminate or suspend your use of the RCS Service. Events beyond our control may also affect our RCS Service. The RCS Service may be subject to outages, delays and traffic congestion and there is a risk of non-delivery or delayed delivery. There are limitations to wireless messaging which by their nature do not permit or may delay the delivery of RCS Messages due to our network, a user's location, plan, permissions or connection. RCS Messages may not be successfully received or sent due to use of an incompatible device or carrier plan; a device may be turned off, out of range, or not working properly; a user's device storage may be full; or a carrier may have blocked RCS Message(s); there may be insufficient network capacity and/or interference due to equipment, terrain, proximity to buildings, foliage, and weather. Due to cellular coverage and system limitations, we do not guarantee the availability, security, and reliability, delivery speed or timeliness of RCS Message delivery.

    Acceptable Use Policy.

    You must access and use the RCS Service only for legal, authorized and acceptable purposes. You may not use the RCS Service in a way that violates, misappropriates, or infringes our rights nor those of others including privacy, publicity, intellectual property or other rights, or that is illegal or harms Verizon, our users or others. You agree that your use of the RCS Service will comply with any applicable local, state, national and international laws and regulations, including messaging laws, anti-spam, export control, intellectual property and privacy laws. Verizon's failure to take any action, shall not amount to a waiver of any right to enforce these Terms. You are solely responsible for the RCS Messages you send, receive, access, or transmit through the RCS Service and Verizon is not liable for the same. You must not send unwanted messages through the RCS Service which includes any content, links or messaging that: amounts to spam (unsolicited bulk commercial messages), "phishing" (messages intended to access private or confidential information through deception or otherwise); contains executable files or links to other content; is premium or messaging that requires a subscription or surcharge; is harassing, bullying, libelous, defamatory, obscene, harmful, vulgar, tortious, encourages harm to children; celebrates, encourages or depicts discrimination, harm, or violence; degrades, intimidates, encourages illegal conduct, dehumanizes, causes safety concerns; provides instructions on illegal activities; incites violence; is racially or ethnically offensive; causes consumer complaints; does not meet community standards or is otherwise objectionable or inappropriate in the opinion of Verizon. You will not use the RCS Service to create a false identity, provide false information or otherwise attempt to mislead others as to identity or the origin of an RCS Message. RCS Messages must not contain junk mail, pyramid schemes or the like. Verizon, other interconnected carriers and our service providers may restrict, block, or throttle traffic Verizon may suspend, alter or terminate the RCS Service for breach of this clause.

    You agree to reasonably cooperate with us and/or any governmental authority in investigating any violation or prohibited use of the RCS Service.

    Security.

    You are responsible for keeping your device(s) secure.

    Beta Features.

    We may release features or functionality that are still being evaluated or tested ("Beta Feature"). We will advise you in the application if something is a Beta Feature. We may ask you to provide Feedback for a Beta Feature, or to fill out a survey, but you are not obligated to do so. We may or may not use such feedback to improve the Beta Feature and/or the RCS Service. We may reach out to you regarding your Feedback. Our Acceptable Use policy applies to any Feedback you provide. If you choose to use a Beta Feature, note that it may change from its Feta version and may not perform as reliably as other non-Beta Features. We may change, suspend, or discontinue a Beta Feature at any time without notice.

    Intellectual Property and Feedback.

    Verizon owns or licenses all rights, including intellectual property rights, in the RCS Service and its components, software, tools, documentation, and other materials relating to it, including modifications, updates, revisions or enhancements. All rights not explicitly given are reserved by Verizon. Providing feedback is important to help us improve our app and service. Should you provide Verizon with information, including, but not limited to, feedback, data, answers, questions, comments, suggestions, improvements, observations, evaluation information plans, ideas, or the like, (collectively "Feedback"), either orally or in writing, and Verizon shall be free to use any such Feedback for any purpose including but not limited to modification and improvement of the RCS Service without compensation and Verizon shall own all the intellectual property rights relating to such Feedback including any RCS Service modifications and improvements. To the extent you provide any Feedback, you hereby assign all intellectual property rights in such Feedback to Verizon and agree not to assert any related rights against Verizon.

    License Rights and Restrictions.

    Subject to these Terms, Verizon grants to you a personal, revocable, limited, non-exclusive, non-transferable, non-sublicensable license to access and use the RCS Service as per these Terms. This license is for the sole purpose of enabling you to use our RCS Service as allowed under these Terms. No implied license is granted. You shall not and shall not allow any third party to (a) charge for, provide, lease, sell, resell, make available, or lend the RCS Service in whole or in part to any third party; (b) use the RCS Service for any unlawful or fraudulent purpose including but not limited to harvesting or collecting information about others (or attempting to) or misrepresenting your identity; (c) breach these Terms or Verizon’s policies; or (d) use the RCS Service in a way that interferes with, disrupts, damages, impacts or inappropriately accesses the RCS Service, servers, networks, or other properties or services of Verizon; harms or poses a risk to Verizon, our customers or other users; attempts to bypass or breach any security mechanism or poses a security or service risk; may subject us or any third party to liability; or introduce any virus, Trojan horse, or any other malicious, harmful or deleterious program.

    Suspension/Termination.

    Verizon may without notice suspend, terminate, limit, temporarily block access to, modify, or discontinue your use of the RCS Service, including but not limited to: if you breach these Terms or any other agreement you have with us; as part of Verizon maintenance; if we change, discontinue or improve the RCS Service; to prevent or manage any security issues or potential fraud; to protect or prevent harm to Verizon, our assets, systems, networks, other users, the public, or our suppliers; or due to the impact of any requirement, ruling, regulation, operational or other government change impacting the RCS Service. Such action may result in a loss of RCS Messages, deletion of RCS Messages, and loss of access to the RCS Service for which Verizon shall not be liable. Verizon shall have no liability for any damage, liabilities, losses (including loss of data, Content or profile) or any other consequences you incur as a result of any suspension, modification, limitation or termination of the RCS Service. Sections of these Terms relating to our license to you, restrictions, service limitations, disclaimer of warranty, copyright, intellectual property, limitation of liability, indemnification, termination and other terms that by their nature would apply post-termination, continue to apply after termination of the RCS Service.

    HIPAA/Confidential Information.

    The RCS Service is not HIPAA compliant and not designed for secure transmission or storage of personal healthcare information. Do not use the RCS Service for the sending of confidential information or to store or transmit Protected Health Information (PHI) as defined in the Health Insurance Portability & Accountability Act of 1996 and the Health Information Technology for Economic and Clinical Health Act of 2009 and accompanying regulations (collectively "HIPAA"). If you are a Covered Entity or a Business Associate as defined by HIPAA, you must not use the RCS Service to store or transmit PHI. If your business is a Covered Entity or Business Associate as defined by HIPAA, or an entity that otherwise does not want its users to save RCS Messages to the cloud, a Verizon authorized representative must block Messaging.

    Copyrights.

    Verizon does not monitor or control RCS Messages including content such as photos, GIFs, media files and videos sent to or received by the RCS Service and we disclaim all responsibility for the same. You must ensure any content sent by you is not copyright protected so check before you send or attach RCS Messages including content. All content must meet our Acceptable Use Standards as set out in these Terms. You agree that you will not attach or send content that infringes any copyright, and you agree you are fully responsible for any copyright infringement resulting from your use of the RCS Service and that Verizon may terminate any user that infringement the copyrights of others. Pursuant to Title II of the DCMA, all claims alleging copyright infringement for material that is believed to be residing on Verizon's system or network should be promptly sent in the form of written notice to Verizon's Designated Agent. For any Feature that is provided by a third party, their terms of use would apply and should be referred to (see below section).

    Third Party Features and Terms.

    Our RCS Service may allow you to access, use or interact with third party features, websites, apps, content or services that are integrated with our RCS Service. Your use of the RCS Service for certain features is subject to specific Terms of Use of those third parties. Your dealings or communications through our RCS Service with any party other than our RCS Service are solely between you and that third party. Under no circumstances will Verizon be liable for any goods, services, resources or content available through such third party dealings or communications, or for any harm related thereto. Please review carefully that third party's terms of service, policies and practices and make sure you are comfortable with those policies and practices before you engage in any transaction. Any complaints, concerns or questions you may have relating to materials provided by third parties should be forwarded directly to the third party.

    DISCLAIMER OF WARRANTY.

    YOUR USE OF THE RCS SERVICE IS AT YOUR OWN RISK AND IS PROVIDED "AS IS" AND "AS AVAILABLE". VERIZON, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, PARENTS, SUBSIDIARIES, AFFILIATES, THIRD PARTY LICENSORS, RCS SERVICE PROVIDERS, VENDORS, AGENTS AND SUPPLIERS ("COVERED PARTIES"), DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, TITLE, INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, SUITABILITY, RCS MESSAGE DELIVERY OR TIMELINESS OF THE SAME, SECURITY MECHANISMS OR CONTROLS, SYNCHING, ACCURACY, COMPLETENESS, RELIABILITY, THAT THE RCS SERVICE WILL BE OPERATIONAL, ERROR FREE, SECURE, OR SAFE, OR WILL BE WITHOUT FAILURE, DELAY, INTERRUPTION, LOSS OF OR DAMAGE TO CONTENT, DATA OR INFORMATION, FREE FROM COMPUTER VIRUS OR OTHER HARMFUL CODE, WILL MEET YOUR NEEDS OR EXPECTATIONS OR WARRANTIES ARISING UNDER STATUTE. WE DO NOT CONTROL AND ARE NOT RESPONSIBLE FOR USER CONTENT, HOW USERS USE THE RCS SERVICE, OR ANY FEATURE OR INTERFACES WE PROVIDE. YOU ASSUME THE SOLE COST OF ANY RCS SERVICE AND REPAIR RELATING TO YOUR USE OF THE RCS SERVICE AND FOR ANY DAMAGE TO YOUR DEVICE(S), DATA, CONTENT, COMPUTER OR OTHER SYSTEM RESULTING FROM USE OF THE RCS SERVICE. NO ADVICE OR INFORMATION, WRITTEN OR ORAL, SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED HEREIN. BY USING THE RCS SERVICE.

    LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT ALLOWED UNDER THE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, INCLUDING TORT, CONTRACT, PRODUCT LIABILITY, OR OTHERWISE, SHALL VERIZON, NOR ANY OF ITS OFFICERS, DIRECTORS, EMPLOYEES, PARENTS, SUBSIDIARIES, AFFILIATES, RESELLERS, RCS SERVICE PROVIDERS, AGENTS, SUPPLIERS, OR THIRD PARTY LICENSORS ("COVERED PARTIES") BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES, LOSSES, FEES OR COSTS WHATSOEVER, WHETHER DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, CONSEQUENTIAL OR EXEMPLARY, INCLUDING, WITHOUT LIMITATION, RELATING TO PERSONAL INJURY, DAMAGE TO PERSONAL, PROPERTY, PRIVACY OR PUBLICITY RIGHTS OF ANY NATURE, LOST PROFITS, LOST, INACCURATE OR DAMAGED CONTENT/RCS MESSAGES OR DATA, LOST GOODWILL, LOST BUSINESS, OR OTHER INTANGIBLE LOSSES, CONDUCT OF A THIRD PARTY, WORK STOPPAGE, COMPUTER OR DEVICE FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES, LOSSES, FEES OR COSTS EVEN IF VERIZON WAS INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RELATE TO, ARE A RESULT OF THE USE OF, OR INABILITY TO USE THE RCS SERVICE OR ANY FEATURE. COVERED PARTIES SHALL AT NO TIME BE LIABLE FOR ANY DAMAGE, LOSS OR INJURY AS A RESULT OF HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE RCS SERVICE.

    INDEMNIFICATION.

    YOU SHALL INDEMNIFY, DEFEND AND HOLD HARMLESS VERIZON AND ITS PARENTS, AFFILIATES, SUBSIDIARIES, SUCCESSORS, ASSIGNS, EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, SUPPLIERS, RCS SERVICE PROVIDERS AND LICENSORS, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, AGENTS AND EMPLOYEES (THE "INDEMNIFIED PARTIES") FROM AND AGAINST ANY CLAIM, DEMAND, PROCEEDING, LOSS, DAMAGE, COST, FINE, PENALTY, FEES, INTEREST, CONSEQUENTIAL LOSS, AND/OR EXPENSE (INCLUDING ATTORNEY AND OTHER PROFESSIONAL FEES) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE RCS SERVICE, INCLUDING WITHOUT LIMITATION, ANY RCS MESSAGES YOU SEND, RECEIVE, STORE, DISPLAY OR ACCESS; ALLEGED OR ACTUAL BREACH OF THESE TERMS OR ANY THIRD PARTY TERMS OR RIGHTS; ANY VIOLATION OF APPLICABLE LAW OR REGULATION; YOUR CONDUCT RESULTING IN ANY PROPERTY DAMAGE, LOSS, OR INJURY TO A PERSON OR THEIR RIGHTS; OR MISUSE OF THE RCS SERVICE INCLUDING BY ANY NEGLIGENCE OR WILLFUL MISCONDUCT. YOU WILL PROMPTLY NOTIFY VERIZON OF ANY CLAIM RELATED TO YOUR USE OF THE RCS SERVICE.

    Driving Safety.

    Verizon is not responsible for use of the RCS Service while driving including with automated auto services in your vehicle that may read, display, and/or send text or voice messages. Safe driving is your responsibility.

    Other Verizon Services.

    These Terms do not apply to any other features and services provided by Verizon (e.g., voice calling and text messaging, including SMS and MMS).
